Blantyre Senior Resident Magistrate Court sets Mwafulirwa free

Morton Mwafulirwa celebrates his acquittal

Morton Mwafulirwa is a former IT Manager at CFAO Motors who was arrested on allegations that on 8th April 2021, he had attempted to access data from a personal computer containing information of senior and junior employees of CFAO Motors.

Mr. Mwafulirwa was brought to court and charged with the offense of attempted unauthorized access to data, which is contrary to Section 93 (1) as read with Section 84 (3) of the Electronic Transaction and Cyber Security Act.

At the Senior Resident Magistrate court in Blantyre, he was represented by Legal Aid Bureau. In the matter, the state paraded four witnesses to prove that he indeed committed the said offense but after a full trial, the court found that the accused had not committed the offense.

It was further observed by Senior Resident Magistrate His Worship Mwanyongo that there was no evidence from an IT person at CFAO Motors to confirm that Mr. Mwafulirwa tampered with the said system.

He was then acquitted on 15 November 2022. Counsel representing the legally aided Morton Mwafulirwa, Senior Legal Aid Advocate Tiwonge Penama, expressed satisfaction with the outcome of the judgment.

“It is always pleasing to see a client being set free after being represented by the Bureau,” added Counsel Penama.
